At Tech Mahindra Global Chess League AG (“GCL”), we are committed to respecting the privacy rights of the visitors to our website www.globalchessleague.com (“Website”), the Global Chess League official mobile application ‘GCL Fan Center’ (“App”), and the GCL metaverse platform (“GCL Metaverse”, and together with the Website and the App, the “Platform”). Scope of Application This Privacy Policy outlines how and why we collect and use certain information from which you are personally identifiable ("Personal Information ”) through the Platform. It also explains:
  • What information we may collect about you online;
  • The use and role of cookies and similar technologies on our Platform;
  • How we will protect and use the information we collect about and from you;
  • The circumstances in which we might disclose your details to anyone else;
  • When we may use your details to contact you; and
  • How you can be sure the information we hold about you is accurate and current
If you do not agree to this Privacy Policy, please do not access or use our Website and/or App and/or the GCL Metaverse or any services, products or content provided on the Platform. Your access to or use of any part of the Platform and/or any services or content provided therein indicates your acceptance of this Privacy Policy and all the terms contained herein. The terms ‘GCL’ or ‘Company’ or ‘us’ or ‘our’ or ‘we’ refer to the owner of the Platform. The term ‘you’ or ‘user’ refers to the user, visitor, or viewer of our Platform.   What Personal Information we may collect In general, you can visit our Website without revealing your identity or any Personal Information about yourself. However, you may not be able to use our App and/or the GCL Metaverse and/or access certain areas or services of our Website that require registration or need you to reveal your identity and/or other information about you. Information that we collect from you will vary depending upon the activity you seek to engage in and may include your name and email address. In addition, we may collect demographic information such as gender, information about your computer, device, hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths, and other data that you may provide in surveys or online profiles. We may combine demographic information with Personal Information to tailor our offerings, content or web pages to your preferences or interests. Personal Information collected in this way may include: 
  • Identity: name, social media account handle/username, and photographs.
  • Contact: email address
  • Profile: your preferences for marketing, other website or technology preferences, your contact history, and feedback on your Website experience (through surveys or online profiles).
  We may also collect the following types of Personal Information from you when you use our Website or the GCL Metaverse, through the use of cookies and similar technologies:
  • Technical: device IDs, browser type, IP address, operating system, central processing unit and other hardware types, network and software identifiers, location data, operating system and system configuration.
  • Usage: visitor information e.g. feature usage, time spent on page, click paths, download errors, browsing patterns, and dates and times of access.

Except for User Profile passwords and any financial information, GCL does not collect any Sensitive Personal Information (“SPI”) via the Platform. SPI has slightly different meanings in different countries but generally means more sensitive Personal Information such as passwords; physical, physiological and mental health conditions; racial or ethnic information; political opinions or associations; religious or philosophical beliefs; trade union memberships; medical records and history; biometric Information; sexual orientation; and, in some cases, financial information (such as bank account details or credit card numbers). In the event we collect Personal Information from you, or a third party, in circumstances where we have not requested or solicited that information (known as unsolicited information), and it is determined by us (in our absolute discretion) that the Personal Information is not required, we will destroy the information or ensure that the information is de-identified. Children: You must be at least 16 years of age to create a User Profile or use our products or services. We do not intentionally collect or process any Personal Information concerning children. Why we collect, Use and Store the Personal Information Collection of personal information for propagating business: From time to time, we may request the aforementioned Personal Information from you to facilitate your use of our Platform, as well as to provide the services you have requested, including services that display customized content, and to contact you upon your request and when otherwise necessary. In addition, we may also use your Personal Information for other business purposes or in order to help serve you better, such as informing you of new services, features, or products. Your posting of any such Personal Information is entirely at your discretion. While you can visit our Website without disclosing any Personal Information, access to certain Services and products on the Platform, as well as the ability to interact with certain features and Content (defined herein) and avail of certain features and functionalities of the Platform, require completion of a registration process to create a User Profile as detailed in the Terms of Use. The registration and creation of a User Profile requires you to reveal your identity and/or other information about yourself, as set out in the Terms of Use.  We may also use Personal Information for auditing, research and analysis, and to operate and improve our Platform and/or services. We may further use Personal Information for sending you surveys and marketing communications; to engage in technical maintenance and troubleshooting problems and errors associated with our Platform; or as otherwise set forth in this Privacy Policy or any other terms or policies applicable to our Platform. In certain circumstances, we may share aggregated non-personal information with third parties. When we use third parties to assist us in processing your Personal Information, we require that they comply with our Privacy Policy and any other appropriate confidentiality and security measures. We may also share such information with third parties in limited circumstances, including when complying with legal processes, preventing fraud or imminent harm, and ensuring the security of our network and services. You will also be given the opportunity to withhold or withdraw your consent for the use of your Personal Information other than as listed above.  Use of Personal Information on GCL Metaverse The Personal Information and other information collected in the course of your access, registration and/or usage of the GCL Metaverse will be available to GCL for collection, use, storage and sharing, and may be used by GCL for the following purposes:
  • To enable you to access and participate in a contest on the GCL Metaverse, participate in any promotion thereon or otherwise access and use the products or services offered through the GCL Metaverse;
  • To track your usage of the GCL Metaverse and any contest, promotions, products and services offered thereon;
  • To track your performance in the contest(s) or promotion(s), if any, offered on the GCL Metaverse, and tabulate and publish results, declare winners and distribute prize(s) (if any) pursuant to such participation;
  • To deal with your requests, enquiries and complaints in relation to the GCL Metaverse;
  • To personalise your experience of the GCL Metaverse, and the services provided thereon;
  • To improve our services, products, contests and promotions offered through the GCL Metaverse, and to better your experience of the same;
  • To show you relevant advertising and recommend services, which we think might interest you;
  • To contact you about our service, the services of GCL’s commercial partners and any other matters that we think may interest you.
We may also share your information with our personnel, commercial partners and service providers for the purpose of enabling your participation in the GCL Metaverse and for the purposes set out above. Use of Cookies and Tracking Technologies To the extent you have given your consent, our Website uses a technology called a “cookie”. Generally, an IP address changes each time you connect to the Internet (it is a “dynamic” address). We use your IP address to report aggregate information on use and to help improve the Website. Areas of this Website that collect your Information use industry-standard secure socket layer encryption (SSL), reasonable security controls, and appropriate technical, and physical organizational security controls are employed for the protection of data; however, to take advantage of this your browser must support encryption protection (found in Chrome, Internet Explorer release 3.0 and above). Disclosure to third parties We will keep confidential and protect your Personal Information to the extent set out in this Privacy Policy. The Company reserves the right to share your Personal Information in instances where we have a good-faith belief that it is necessary to comply with a court order, legal obligation, or legal process requests from governmental or judicial authorities or to exercise our legal rights or defend against legal claims or to detect, prevent, or otherwise address security, fraud, imminent harm or technical issues, or to enforce this Privacy Policy and any other policies pertaining to the Platform, including investigation of any potential violation thereof, or where use and disclosure thereof has been permitted by you or is otherwise permitted under this Privacy Policy  We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and, once we receive it, for storage and disposal. When you enter sensitive information on our registration or order forms, we encrypt that information using secure socket layer (SSL) technology. All information we gather is securely stored within databases controlled by us. As we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. The use of Personal Information by such websites, services or applications shall be governed by the privacy policies provided therein. Therefore, if you visit a third-party website, service or application that is linked to our Platform, you should consult that website's/service’s/application’s privacy policy before providing any Personal Information. Monitoring Where permitted by applicable law, GCL reserves the right to monitor, intercept, access and erase all information, material, data and communication (including emails, telephonic conversations and voicemail recordings) regarding registration and further processing of your membership or User Profile through the Platform. How we share your Personal Information In the event that the GCL business is sold or integrated with another business in total or in part, your details may be disclosed to our advisers and prospective purchaser’s advisers and will be passed on to the new owners of the business. Please note, for Applicants from European Economic Area (EEA), your Personal Information will be processed in or accessed globally, including but not limited from a jurisdiction outside the EEA by members of GCL and categories of recipients (e.g. third-party providers) in a jurisdiction that does not have equivalent data protection laws to those in the EEA for the purpose outlined above. When we transfer your data, we ensure to use an agreement containing European Commission-approved standard contractual clauses. When we transfer your data to outside GCL, we use the European Commission ’s adequacy decisions and rely on standard contractual clauses to safeguard the transfer, unless we transfer the data to a third party, that has implemented binding contractual rules, in which case, we may rely on one of those mechanisms to safeguard the transfer as applicable and obtain your consent for the data transfers to the United States and other countries.   • in relation to the functioning of any product or service you have signed up for on the Platform in order to ensure that we can deliver such product or services to you;

How long we retain your Personal Information We will retain your Personal Information only for as long as we need it for GCL’s legitimate business interest in accordance with applicable laws, to fulfill your registration process and to perform services as you have opted for or to meet legal requirements, after which we will take steps to delete your Personal Information or hold it in a form that no longer identifies you. We may retain your Personal Information for historic reference and record of your performance in the contest(s) and promotion(s) (if any) offered through the GCL Metaverse.  Updates to this Privacy Policy This Privacy Policy may be updated periodically. We will encourage you to check for changes to this Privacy Policy occasionally, which will be available on the mobile app menu and at: https://fancenter.globalchessleague.com/privacy-policy/  On some occasions, we may also actively advise you of specific data handling activities or significant changes to this Privacy Policy, as required by the applicable law.
